This agreement is between suncoastemall.com, and the authorized person placing an order for this hosting account:
The Authorized Person will hereafter be referred to as "User."
1- Subject to the provisions hereof, the account will be opened upon reception of contract, and repeated in each successive billable period thereafter at the then applicable prevailing rates and charges, unless written notice of cancellation is received from User at least
30 days prior to the beginning of the next billable period.
2- Charges for "billable period rate" services are payable prior to the beginning of each period.
Failure to pay in no way relieves the user's obligations to make full payment. User hereby agrees to pay any and all attorney fees, court costs, and related expenses incurred by
suncoastemall.com in the collection of any amount due it.
3- suncoastemall.com may, with 30 days written notice, amend the rates and or charges for any future server usage and/or services.
4- User agrees to use all suncoastemall.com services and facilities at User's own risk.

specifically disclaims all warranties of merchantability and fitness for a
particular purpose.
In no event shall suncoastemall.com be liable for any loss, or loss of data, or any other damages.
5- User agrees to protect and indemnify suncoastemall.com against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from User's use of suncoastemall.com services.
6- suncoastemall.com reserves the right to cancel any account, at any time, without notice, for
any reason suncoastemall.com considers appropriate. Use of the email system to send unsolicited email or Usenet postings is not allowed from any suncoastemall.com account.
"Sexually Explicit Adult Content" is not allowed on a suncoastemall.com Server.
At suncoastemall.com's discretion, access to suncoastemall.com's Internet Account may be
revoked
at any time for abusive conduct on the system and/or the Internet and its resources as a
whole.
7- User agrees not to use disk space provided by suncoastemall.com for uploading files not
directly
related to his web site. At suncoastemall.com's discretion, any such activities deemed
inappropriate
by suncoastemall.com may result in termination of access to suncoastemall.com's
Internet Account. User also agrees not to use any server side program that requires unusual amount of server
resources. If and when User web site's server processing usage exceeds what is considered usual, suncoastemall.com shall offer new pricing deemed appropriate for such usage by
suncoastemall.com.
If User declines the said offer, suncoastemall.com may cancel User account at
suncoastemall.com's
discretion. suncoastemall.com shall be the sole arbiter of what constitutes
unusual amount of server
resources. User agrees not to store any archival files in the disk space
on suncoastemall.com's servers.
90% of files stored on the servers must be linked to the web site. Violation of this rule may result in
termination of access to suncoastemall.com's Internet Account. Web sites designed to distribute
software and/or multimedia files are subject to special pricing. Accounts may not purchase disk space for resale.
8- User is solely responsible for usage of suncoastemall.com and any statement User makes on suncoastemall.com's system may be deemed a "publication " of the information entered. Acknowledging the foregoing, User specifically agrees not to use suncoastemall.com's service in any manner that is illegal, libelous, or against any suncoastemall.com policy.
9- suncoastemall.com reserves the right to cancel any services/account with out notice for
reasons it sees as fit and just.
10- For Web hosting contracts the full
monthly contract amount
except for setup fees, domain registration fees, and charge for overages
will be refunded if suncoastemall.com
is notified within the first 30 days following activation. However, any overage charges AND a fee of $35 will
be subtracted from your refund to cover setup and domain name registration charges, regardless of whether your
plan had any setup fees. No refund is available after the 30th day. All cancellation request must be
submitted to suncoastemall.com by email or regular postal mail.
11- The billable service period begins on the date the services indicated in this agreement
become available
to User. Any traffic overage will be billed immediately after it occurs. Traffic overage will be calculated
using monthly traffic limits.
I agree to allow Brush Man (on behalf of suncoastemall.com) to charge my credit card an initial
payment for
internet services which includes the initial package price plus a one-time setup fee. I
also agree to
allow Brush Man (on behalf of suncoastemall.com) to charge my credit card
monthly for the service packages
and monthly at the renewal price for the other packages after the initial package duration has expired.
This agreement will be in effect until cancellation by either
party in written notice at least 7 days
before the due date.
12- Our service is based on the subscriber having a working knowledge of
the WWW, FTP, Telnet, Email and Front Page (if used). If the Web Site
has to be reset the cost is $150.00 for a complete rebuild of the server
data base.
13- Acceptance of this contract also indicated the User has read and agreed to our Acceptable Use Policy and Billing Policy (see
policy).
14-I understand that Brush Man (agent for suncoastemall.com) prosecutes for credit card fraud
to the fullest
extent of the law. IP addresses are captured exactly for this purpose.
I agree to the above terms and acknowledge that submitting the order form for all
intents and
purposes is the equivalent to my on-line signature.
